By accessing or using the SwiftHaul Logistics, Inc. website, requesting a quote, tendering a shipment, or using our tracking services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.
SwiftHaul Logistics, Inc. provides freight transportation, logistics coordination, warehousing, customs brokerage, and related services throughout the United States and internationally. All services are subject to availability, applicable tariffs, and the terms set forth in the applicable Bill of Lading, Rate Confirmation, or Service Agreement.
SwiftHaul reserves the right to refuse any shipment at its sole discretion. The following items are strictly prohibited:
Shippers are responsible for accurate classification, proper packaging, and complete documentation of all cargo. SwiftHaul assumes no liability for losses arising from shipper misrepresentation.
SwiftHaul's liability for loss or damage to cargo is limited to the lesser of the actual value of the goods or USD $0.50 per pound, unless the shipper has declared a higher value and paid the applicable excess valuation charge prior to shipment. Claims for loss or damage must be submitted in writing within 9 months of the delivery date or, in the case of non-delivery, within 9 months of the scheduled delivery date.
SwiftHaul is not liable for delays, loss, or damage caused by acts of God, government actions, strikes, port congestion, customs holds, or other circumstances beyond our reasonable control.
Payment is due within 30 days of invoice date unless otherwise agreed in writing. Accounts more than 30 days past due are subject to a 1.5% monthly finance charge. SwiftHaul reserves the right to assert a carrier's lien on cargo in its possession for unpaid freight charges.
The shipper is responsible for ensuring all international shipments comply with applicable export control laws, including the Export Administration Regulations (EAR) and International Traffic in Arms Regulations (ITAR). SwiftHaul provides customs brokerage as a service but the shipper remains the importer or exporter of record unless explicitly agreed otherwise in writing.
Access to our shipment tracking system is provided for lawful use only. You agree not to attempt unauthorized access to any portion of our systems, scrape tracking data in bulk, or use our tracking services for any purpose other than verifying the status of a legitimate shipment associated with your account.
All content on this website, including text, graphics, logos, and software, is the property of SwiftHaul Logistics, Inc. and is protected by applicable U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.
Our website and services are provided "as is" without warranties of any kind, express or implied. SwiftHaul does not warrant that the website will be uninterrupted or error-free, that tracking information will be real-time accurate at all times, or that any defects will be corrected.
To the maximum extent permitted by law, SwiftHaul shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website, even if we have been advised of the possibility of such damages. Our total liability for any claim shall not exceed the freight charges paid for the specific shipment giving rise to the claim.
These Terms of Service are governed by the laws of the State of Illinois and applicable federal law. Any disputes arising under these terms shall be resolved by binding arbitration in Chicago, Illinois, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
SwiftHaul reserves the right to modify these Terms of Service at any time. Changes become effective upon posting to this page. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
